Wrongful Death

A "wrongful death action" is brought by the family of a person who has died as a result of another's negligent conduct. Wrongful death actions can arise in virtually all areas of human activity. For example, when a person is killed as a result of the negligent operation of a car or truck, it is appropriate for the family to bring a wrongful death action against the negligent driver. Similarly, if a physician or nurse is negligent in failing to provide medical care that meets an accepted standard of care under the circumstances, it is appropriate for the family to pursue fair and just compensation through a wrongful death action.

In Minnesota, and most states, a wrongful death action must be commenced, or brought, by a court-appointed trustee for the heirs and next-of-kin.
